A Florida judge has ordered a debt-collection agency not to contact a debtor and her family via their Facebook profiles, according to Beacon News in St. Petersburg. The woman, who is said to owe less than $400 for an overdue car loan, filed suit against the agency, claiming that it had contacted her friends and family via Facebook and requested that they have her contact the agency to settle her debt. Melanie Beacham’s suit was brought pursuant to a Florida consumer protection law.
It’s interesting and I wonder whether this will have further reaching impact. For example, will other types of collection agents find this avenue closed to them? Will the IRS? Will law enforcement? Was the basis of the ruling the harassment, or the media – that is, was it the message or the messenger?
